Acceptance of Terms
By using the Home Enhancement Chimney website, services, booking forms, or communicating with us, you agree to these Terms of Use. These terms apply to homeowners, property owners, landlords, real estate professionals, and business owners (collectively “Clients”). If you do not agree, do not use our website or request services.
Services Provided
Home Enhancement Chimney provides chimney inspections, camera inspections, masonry repair, relining, waterproofing, flashing repair, caps/crowns, emergency repairs, and related services. Service descriptions on our website are general; specific work is described in the written estimate provided before work begins.
Booking, Estimates & Acceptance
- Booking: Appointments can be scheduled by phone or via our online request form. Appointment times are estimated; arrival windows may be provided.
- Estimates: We provide written estimates after inspection (or based on information provided). Work begins after you accept the estimate and any required deposit is received.
- Changes: Any change to scope may require a revised estimate and timeframe.
Access & Client Responsibilities
Clients must provide safe, reasonable access to the property, including power, clear work areas, and access to attics/roofs as needed. You must disclose known hazards (asbestos, unsafe structures, pets, etc.). We are not liable for delays or increased costs caused by unsafe or blocked access or undisclosed hazards.
Payment & Deposits
- Payment terms are stated on the estimate. Payment is due as agreed (commonly at completion). Acceptable payment methods will be indicated on invoices.
- Deposits: For larger jobs, a deposit may be required to secure scheduling and materials. Deposits are applied to the final balance.
- Late Payments: Late payments may incur interest or collection costs as allowed by law.
Cancellation & Rescheduling
- Clients should provide notice to cancel or reschedule as soon as possible. Cancellation or rescheduling policies (including any fees) are detailed on estimates or confirmation communications.
- We reserve the right to reschedule due to weather, unsafe conditions, illness, or other operational reasons; we will notify you promptly and work to reschedule.
Warranties & Limitations
- Workmanship: Where applicable, we provide limited workmanship warranties described in the written estimate or invoice. Warranty terms vary by service and are voided by misuse, unauthorized modifications, normal wear, or failure to follow maintenance recommendations.
- Materials: Manufacturer warranties on products/materials used are passed through as provided by the manufacturer.
- No Other Warranties: Except as expressly stated, services and materials are provided “as is” and we expressly disclaim all other warranties, express or implied (including merchantability or fitness for a particular purpose).
Liability & Indemnity
- Limitation of Liability: To the maximum extent permitted by law, Home Enhancement Chimney’s total liability for any claim arising from services or use of the website is limited to the amount paid by the Client for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, punitive, or special damages (including loss of use, lost profits, or delays).
- Indemnity: Clients agree to indemnify, defend, and hold harmless Home Enhancement Chimney and its employees, contractors, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from Client’s negligence, breach of these terms, failure to disclose hazards, or misuse of services.
Safety & Risk Acknowledgement
Clients acknowledge that some inspections and repairs require work at height, invasive inspection, or temporary removal of finishes. We take commercially reasonable safety precautions. You accept the inherent risks of construction and inspection activities and will follow our safety instructions.
Property Condition & Pre-Existing Issues
We inspect and report on visible conditions. We are not responsible for pre-existing, hidden, or latent defects not discovered during inspection unless caused by our negligence. If invasive Level 3 work is recommended, additional costs and access may be required.
Photos, Reports & Records
We provide written inspection reports and may include photos or video. We retain records of inspections, reports, and client communications per our retention policy. By engaging us, you grant permission to take photos of the work for record-keeping and reasonable marketing use unless you request otherwise in writing.
User Content & Reviews
Clients may submit reviews and photos. By submitting, you grant us a non-exclusive, royalty-free license to use, reproduce, and publish the content for marketing and promotional purposes. We may remove content that is defamatory, illegal, or violates these terms.
Third-Party Links & Services
Our website may link to third-party sites (e.g., manufacturer pages, review platforms). Links are provided for convenience; we are not responsible for third-party content or practices.
Privacy
Our Privacy Policy explains how we collect, use, and protect personal information. By using our services and website, you consent to our data practices as described in the Privacy Policy.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law provisions. For disputes arising from these Terms or our services, the parties agree to first attempt good-faith negotiation. If unresolved, disputes may be resolved in the state or federal courts located in Lehigh County, Pennsylvania.
Changes to Terms
We may update these Terms of Use. The “Effective date” at the top reflects the current version. Continued use of our website or services after changes constitutes acceptance of the updated terms.
Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
